OFFF Wallpaper Design Contest Rules Thank you for your interest in the OFFF Wallpaper Design Contest. We hope that it will be an inspiring experience and we look forward to seeing your creative designs. Before you start unraveling the meaning of digital art, please read the contest rules carefully. You will be required to include a signed copy of the entry form together with your wall paper submission. Eligibility. Open to legal residents of the 50 United States, the District of Columbia and Canada (excluding residents of the Province of Quebec), 18 or older. Not open to employees or immediate family members (spouses, parents, grandparents, siblings, children and grandchildren) of employees of OFFF or Getty Images. No Purchase Necessary. To enter the contest, you will need to: Use of Images. You may use low-resolution creative images from Getty Images’ site solely in connection with your contest entry. Any use of the images in any other manner or in a commercial manner is strictly prohibited. You must obtain a separate license and pay applicable license fees to Getty Images for any use of the images not specifically licensed herein. Except as otherwise modified in this paragraph, all other terms of the Getty Images Editorial, Rights-Managed and Rights-Ready Image and Film License Agreement, and the Getty Images Royalty-Free License Agreement, both available at http://www.gettyimages.com/Corporate/LicenseInfo.aspx shall apply to your use of the images. Your Original Work. By submitting your contest entry, you represent and warrant that you own all rights in and to the submission, with the exception of any material provided by Getty Images in connection with this contest. You also represent and warrant that your submission is original and has been legally obtained and created; does not infringe the intellectual property rights, privacy or publicity rights or any other legal or moral rights of any third party; or violate applicable laws or regulations; has not been entered in or won previous contests or awards; and has not been published previously in any medium, with the exception of any material provided by Getty Images in connection with this contest. Prizes/Judging. Five (5) winners will be selected by a jury consisting of OFFF representatives and invited artists. Each winner will receive one (1) ticket to the 2007 OFFF New York Festival, to be held November 2-4, 2007. Winning entries may also be displayed on the Getty Images’ website. Potential winners will be notified by phone and/or e-mail within five (5) business days of the judging and may be required to sign an Affidavit of Eligibility and Liability/Publicity Release. The approximate retail value of each prize is $80. The approximate retail value of all prizes is $400. Winners are responsible for paying all costs and expenses related to the prizes that are not specifically mentioned, including but not limited to taxes. Odds of Winning. Odds of winning depend on the number of eligible entries received. Additional Terms. OFFF reserves the right, in its sole discretion, to modify, terminate, or suspend this contest should viruses, worms, bugs, unauthorized human intervention or other causes beyond its control corrupt or impair the administration, security, fairness or proper play of the contest or submission of entries. OFFF is not responsible for any human or other error that may occur in the processing of the entries, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any web site. OFFF is not responsible for injury or damage to any entrant’s or any other computer resulting from downloading any materials in connection with this contest. OFFF reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the contest or web site; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries submitted by such methods. Miscellaneous. By entering, participants agree to be bound by these rules. No transfer, assignment, cash redemption or substitution of prizes is permitted except by OFFF due to prize availability and then with a prize of equal or greater value. Entrants agree that the decisions of OFFF related to this contest are final. By participating in the contest, winners consent to the use of their names, wall paper designs, photographs and/or likenesses in any manner and in any medium for promotional purposes without additional compensation, except where prohibited by law. Any information that you provide on the contest entry form may be disclosed to, and used by, OFFF and Getty Images. By providing this information, you authorize OFFF and/or Getty Images to contact you in relation to the contest. Release. By entering the contest, you agree to release and hold harmless OFFF and Getty Images and their affiliates and agents from any liability whatsoever for any claims, costs, losses or damages of any kind (including, without limitation, those related to personal injury, death, damage to property, infringement of intellectual property rights, rights of publicity or privacy or defamation) arising out of or in connection with (1) your entry in the contest; (2) your acceptance or use of any prize; or (3) otherwise arising out of or relating to the contest.
